FREQUENTLY ASKED QUESTIONS:
International Law
Question:
Do I have any rights in foreign countries?
Answer:
The answer is yes. All foreign countries have a system of laws which governs daily life in that country. However, these laws may be
very different from ours. For example, Mexico’s law is based upon the civil law system. Our system is based upon common law. I will
be glad to discuss some of the details of these differences with you.
Question:
Can I legally buy property in Mexico?
Answer:
The answer is yes if it is done properly. The Mexican Constitution prohibits foreigners from buying property within 60 kilometers of
the ocean and 100 kilometers of the border. However, property can be purchased through a bank trust. If it is for residential use
this is the only way it can be purchased. Many people are misled into other arrangements which are not legal and they soon find out
that they do not have legal title to their property. If you are considering the purchase of property in Mexico, please call me.
Question:
Are lawsuits time consuming and expensive in Mexico?
Answer:
Again, the answer is yes. The Mexican legal system is very different from ours. Lawsuits can take as long as 10 to 12 years. Even
if you win a case that takes this long there may not be much left at the end. This is why I strongly recommend that all contracts
contain arbitration and mediation clauses. If you would like to know what to put in such a clause, please call me.
Question:
Is arbitration and mediation recognized in Mexico?
Answer:
The Mexican Commercial Code contains a provision which regulates arbitration. Moreover it is probably easier to get a Mexican
arbitration award enforced in the United States then it would be to get a judgment enforced. The details of this get somewhat
complicated however, I would be glad to explain it to you if you desire to call me .
Question:
Do I need a Mexican lawyer?
Answer:
With a few, very small exceptions United States lawyers are not permitted to practice law in Mexico. Through my years of work in
Mexico I have found several attorneys who are hardworking, honest and ethical. Whenever I have a case which requires legal work
within Mexico I associate with one of them.
